Terms and conditions

1. Scope

These terms and conditions apply to all contracts concerning the use of the “Gemwise” software between Flownova AI & IT Services GmbH, Lange Straße 27, 29664 Walsrode (the “Provider”) and entrepreneurs within the meaning of § 14 BGB (the “Customer”). The offer is addressed exclusively to entrepreneurs.

2. Subject of the contract

Gemwise is cloud-based software for POS, inventory management and workshop processes (software as a service). The scope of functions follows from the plan booked and any add-on modules booked.

3. Prices and payment

The prices agreed at the time the contract is concluded apply. All prices are net plus statutory VAT. Billing is monthly or yearly in advance; with yearly advance payment, the annual fee equals ten monthly payments.

4. Term and termination

5. Customer obligations

6. Availability and support

7. Data protection and data security

The Provider processes the Customer’s personal data in accordance with the privacy policy and, where required, on the basis of a data processing agreement under Art. 28 GDPR.

9. Final provisions

The law of the Federal Republic of Germany applies. The place of jurisdiction, where permissible, is the Provider’s registered office.
